Where to look for a will, who to ask and where to search for money in Maine.

The will

Which court handles probate

What to do with the original will

After a death, whoever has custody of the will must deliver it with reasonable promptness to a person able to secure its probate, or if no such person is known, to a probate court for filing until probate is sought.

"a person having custody of a will of the testator shall deliver it with reasonable promptness to a person able to secure its probate"

Wills deposited during life

Maine probate courts no longer accept wills for safekeeping; the law says courts may not accept a will for deposit after September 19, 1997. Wills deposited earlier may still be held by the register of probate, so a family can ask the county Probate Court.

"The court may not accept a will for safekeeping after September 19, 1997."

18-C M.R.S. § 2-514. Read the source.
