What to do with the original will

After a death, whoever has custody of the will must deliver it to the probate division of the circuit court with jurisdiction over the estate, or to the probate division in the county where the will is found, which keeps a copy and mails the original to the right court. A will must be presented for probate within the time in § 473.050 (generally one year after death if no letters notice was published).

"to the probate division of the circuit court which has jurisdiction of the estate"

RSMo § 473.043; § 473.050. Read the source.

Wills deposited during life

A living person (or their agent) can deposit a sealed will with the probate division of any circuit court for safekeeping; the clerk issues a certificate of deposit. A family can ask the probate division clerk whether one is on deposit.

"A will may be deposited by the person making it, or by such person's agent, with the probate division of any circuit court"

RSMo § 474.510. Read the source.

Opening a safe deposit box

Once the sole lessee has died, the box may be opened by two bank employees (one an officer) in the presence of persons claiming to be interested in the contents. A will found goes to the probate division; in practice many counties ask the person to petition the probate court first. Applies to banks (362.488); trust companies have a parallel rule (369.212).

RSMo § 362.488. Read the source.
